What the Service is and is not

GameOnGoNow is a discovery platform. We help Fans find out where and when a game is on and what deals a nearby bar or restaurant is running that day. We are not a party to any transaction between a Fan and a Restaurant Partner: we do not take orders, process payments, hold reservations, or sell food, drinks, or alcohol.

Acceptable use

You agree not to:

• Scrape, crawl, or bulk-extract data from the Service outside of what a normal browser session would retrieve;
• Post false, fraudulent, or misleading Content, including fake Deals, fake reviews, or a Listing for a business you do not own or represent;
• Interfere with or attempt to bypass the Service's security, rate limits, or access controls;
• Use the Service to harass, defraud, or impersonate any person or business;
• Use automated means to create accounts or claim Listings at scale.

We may suspend or terminate access for anyone who violates this section.

Game data, schedules, and third-party information

Game times, schedules, and broadcast information are sourced in part from third parties and may be delayed, incomplete, or wrong. Leagues reschedule games, broadcasts change, and networks blackout regionally. Confirm anything time-sensitive directly with the venue.

References to sports leagues, teams, or events (e.g., "NFL," "NBA," team names and logos) are used only to identify which games a Listing shows, not to claim any affiliation, sponsorship, or endorsement by those leagues or teams.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate any account, at our discretion, for violating these Terms, for fraud or abuse, or upon a Restaurant Partner's own request to remove its Listing.

Disclaimers

The Service is provided "as is" and "as available." We do not warrant that Deals, hours, or game information are accurate, complete, or current, or that the Service will be uninterrupted or error-free. To the maximum extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent the law allows, GameOnGoNow will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Service.

Indemnification

You agree to defend and indemnify GameOnGoNow against claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your Content, or your misuse of the Service.

Dispute resolution & arbitration

Before filing a claim, we encourage you to contact us at support@gameongonow.com.

You and GameOnGoNow each waive the right to a jury trial and to participate in a class action or class arbitration. You and GameOnGoNow agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or, for a dispute arising from a Restaurant Partner's business use of the Service, its Commercial Arbitration Rules), rather than in court, except either party may bring an individual claim in small claims court.

You may opt out of this arbitration agreement by emailing support@gameongonow.com within 30 days of first accepting these Terms.

Governing law

These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-law rules.

Changes to these Terms

We may update these Terms as the Service evolves. We will post the updated version here with a new updated date, and for material changes we will make a reasonable effort to notify account holders by email. Continued use after a change takes effect means you accept the update.

Miscellaneous

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and GameOnGoNow regarding the Service. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign your rights without our consent. Our failure to enforce a provision is not a waiver of that provision.

Deals are the Restaurant Partner's, not ours

For a claimed Listing, every Deal is created, priced, and controlled by the Restaurant Partner that posted it. We do not guarantee a Deal is currently accurate, still running, or will be honored exactly as shown. Restaurants can run out of a feature, hit capacity, or change terms with little notice. If a Restaurant Partner will not honor a Deal as posted, that is a dispute between you and that restaurant; we are not liable for this dispute, though we do want to know about it (see Contact below) so we can address bad actors on the platform.

Some Listings are marked "Community Listing." Their information was gathered from public sources and has not yet been confirmed by the business itself. Treat anything on a Community Listing, including any deal or game-showing information, as unverified: it has not been reviewed or approved by the restaurant, and we make no promise it is accurate or current. Call ahead or confirm in person before relying on it.

No payments through the Service

GameOnGoNow does not process payments, take orders, or hold reservations. Everything covered by a Deal (ordering, paying, tipping) happens directly with the restaurant, on its own terms (cash, card, its own Point of Sale, its own tab).

Alcohol-related content

Some Deals involve alcohol. GameOnGoNow is not a licensed alcohol retailer, does not sell or serve alcohol, and is not responsible for a restaurant's age-verification or responsible-service practices. Nothing on the Service is intended to encourage excessive or underage drinking. If you are not of legal drinking age in your state, Deals involving alcohol are not for you.

Location

If you share your location or search a specific area, we use it to show nearby bars and restaurants and, where relevant, to infer things like neighborhood for a venue at claim time. See our Privacy Policy for how location data is handled.

Who can claim a Listing

You may only create or claim a Listing if you are the owner, manager, or someone the business has authorized to represent it online. By claiming a Listing, you represent and warrant that is true.

Accepting these Terms

By creating an account, claiming a Listing, or otherwise using the Service, you agree to these Terms. If you are agreeing on behalf of a restaurant or business, you confirm you are authorized to make such representations on behalf of that business.

Eligibility

Because Deals frequently reference alcohol, you must be at least 21 years old to create an account. Restaurant Partner accounts must be created by someone 21 or older with authority to make the representations delineated in Section 17 of these Terms on behalf of the Restaurant Partner.

We rely on your own certification of your age at signup; we do not run identity or age verification on account creation. If we later learn an account holder is under 21, we may suspend or terminate the account. Actual ID checks for alcohol service remain the licensed venue's responsibility at the point of sale, not ours.

Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information when you sign up, and keep it current. Tell us right away if you suspect unauthorized access.

Content you submit

You keep ownership of Content you submit. By submitting it, you grant GameOnGoNow a non-exclusive and royalty-free license to display, reproduce, and distribute the Content as part of operating and promoting the Service. You confirm you have the rights necessary to grant that license, for example, that you own or are licensed to use any photo you upload.

Communications

We will send account-related emails (confirmation, security, service notices) to the address on your account; these are not optional while you hold an account. Marketing or reminder emails (like game-day agenda reminders) include an unsubscribe option and stop once you opt out.

Verifying and disputing a claim

We may take reasonable steps to verify a claim before activating a Listing. If someone claims a Listing for your business without authorization, contact us at support@gameongonow.com.

Keeping your Listing accurate and honoring what you post

You are responsible for keeping your Listing's hours, location, game-showing information, and Deals accurate and current. If you post a Deal, honor it for any Fan who presents it in good faith during the window you posted, unless you clearly disclosed a limit on the Listing itself (e.g., "while supplies last," "dine-in only," "one per table," blackout dates). If you need to end or change a live Deal, update the Listing promptly. Do not leave a stale Deal up that you no longer intend to honor.

Compliance with law is on you

You are solely responsible for your business's compliance with all applicable law, including:

• Your liquor license and your state's alcohol-beverage-control rules, including any restrictions on how drink specials, "happy hour" pricing, or alcohol promotions can be advertised online, which vary significantly by state;
• Food safety and health-code requirements;
• Truthful, non-deceptive advertising and pricing;
• Any tax obligations tied to sales made at your business.

GameOnGoNow is not a licensed alcohol retailer, does not review Deals for regulatory compliance in your state before they go live, and takes no responsibility for a Restaurant Partner's compliance failures.

License to your business content

You grant GameOnGoNow a non-exclusive and royalty-free license to display your business name, logo, photos, and Deal descriptions on the Service and to use them in promotional materials for the Service (app store listings, social posts, marketing emails).

Fees

Listing a business on GameOnGoNow is currently free. We may introduce paid plans or premium features in the future; if we do, we will give at least 30 days' notice before any fee applies to your account, and you can cancel before the fee takes effect at no cost.

Suspending or removing a Listing

We may edit, suspend, or remove a Listing or a specific Deal that is inaccurate, fraudulent, unlawful, or otherwise violates these Terms. We will generally try to notify you first, but may act immediately for serious violations (fraud, illegal content, repeated failure to honor posted Deals).

Independent business relationship

Nothing in these Terms creates an agency, employment, partnership, joint venture, or franchise relationship between GameOnGoNow and your business. You are solely responsible for your premises, staff, and the food, beverages, and service you provide.

Indemnification by Restaurant Partners

In addition to Part 2's general indemnification, you agree to defend and indemnify GameOnGoNow against claims arising from: your food, beverage, or alcohol service; conditions on your premises; your employees or agents; your failure to honor a posted Deal; or inaccurate Listing content.

Ending the relationship

Either of us may end your Listing at any time: you by request, us per the section above. On termination, your Listing comes down from live searches, but marketing materials already distributed under the license in this Part (e.g., a social post or email already sent) may remain in circulation.
